GSTIN: ), having its registered office at
CTS NO-16035, PLOT NO-110, A-62, Shrikrishna Nagar, Ulkanagari, Chhatrapati Sambhajinagar, Maharashtra 431009 ("Company", "we", "us", "our").
By accessing the Site, booking an appointment, or making a payment, you
("User", "you", "your") agree to be bound by these Terms, our
Privacy Policy, and
our Refund & Cancellation Policy.
If you do not agree, please do not use the Site.
This document is an electronic record under the Information Technology Act,
2000 and rules thereunder, and does not require a physical or digital signature.
1. Services Offered
The Company is a medical diagnostic centre providing services including, but
not limited to:
- PET CT Scan
- Iodine-131 Therapy (low dose and high dose)
- Lu-177 DOTATATE Therapy
- Nuclear medicine imaging and associated diagnostic services
All services are provided at the Company's premises in Chhatrapati
Sambhajinagar (Aurangabad), Maharashtra. The Site is only an informational
and booking/payment portal for these services.
2. Eligibility
You must be at least 18 years old and legally competent to contract under the
Indian Contract Act, 1872 to book an appointment or make a payment on this
Site. If you are booking on behalf of a minor or a person who cannot contract
for themselves, you represent that you are their legal guardian.
3. Appointments
- An appointment slot is confirmed only after we have accepted it and (where
applicable) the advance payment has been received.
- All appointments are subject to availability of equipment, medical staff,
and radio-pharmaceuticals (where required).
- You must provide accurate personal, contact, and medical information.
Incorrect information may delay, cancel, or render invalid any service or
report.
- You must arrive at the scheduled time, carrying a valid photo ID, referring
doctor's prescription (where applicable), prior reports, and pre-procedure
preparation instructions shared by us.
- We reserve the right to reschedule an appointment due to medical
necessity, equipment downtime, isotope delivery delays, or events of
force majeure. We will make best efforts to inform you in advance.
4. Payments
- All prices on the Site are in Indian Rupees (INR / ₹) and are inclusive
of applicable GST unless stated otherwise.
- Online payments are processed through PhonePe Payment
Gateway, operated by PhonePe Private Limited. By making a payment,
you additionally agree to PhonePe's terms and conditions
(
phonepe.com/terms-conditions
).
- We accept UPI, debit cards, credit cards, net banking, and wallet
instruments supported by PhonePe.
- We do not store your full card number, CVV, UPI PIN, or net-banking
credentials. These are handled directly by PhonePe on its PCI-DSS compliant
infrastructure.
- A payment is considered successful only when we receive a
"COMPLETED"/"SUCCESS" confirmation from PhonePe via server-to-server
callback. Until then, the transaction is treated as "Pending".
- If an amount is debited from your account but our system does not receive
a success callback within 24 hours, the amount will be automatically
refunded by PhonePe/your bank to the original instrument, usually within
5–7 working days.
- A tax invoice will be issued for every successful payment and sent to your
registered email address.
5. Refund and Cancellation
Refund and cancellation are governed by our separate
Refund &
Cancellation Policy, which forms an integral part of these Terms.
6. Medical Disclaimer
The content of this Site — including information about services, conditions,
procedures, and FAQs — is provided for general informational purposes only. It
is not a substitute for professional medical advice,
diagnosis, or treatment.
- Always seek the advice of your physician or another qualified health
provider with any questions you may have regarding a medical condition.
- Never disregard professional medical advice or delay seeking it because of
something you have read on this Site.
- Diagnostic reports issued by us must be interpreted by a qualified medical
professional; we do not provide treatment recommendations unless explicitly
part of a booked service.
In a medical emergency, call your doctor or the nearest hospital immediately.
This Site is not designed to handle emergencies.
7. Acceptable Use
You agree that you will not, and will not attempt to:
- Use the Site for any unlawful, fraudulent, or abusive purpose.
- Book an appointment or make a payment using stolen or unauthorised payment
instruments, or in another person's name without their consent.
- Probe, scan, test, or circumvent the security of the Site or any
associated system.
- Upload any virus, malware, or harmful code; attempt to gain unauthorised
access to any account, server, or database.
- Copy, reproduce, mirror, scrape, frame, deep-link, or otherwise exploit
any content on the Site for commercial purposes without our prior written
consent.
- Impersonate any person or misrepresent your affiliation with any person or
entity.
- Post or transmit any content that is defamatory, obscene, threatening, or
infringes the intellectual-property or privacy rights of any third party.
Violation of this section may result in termination of your access,
cancellation of bookings, refusal of service, and/or legal action.
8. Intellectual Property
All content on the Site — including the trade name "Emrald Medical
Research", logos, text, graphics, images, icons, and software — is the
property of the Company or its licensors and is protected by Indian copyright
and trademark law. You are granted a limited, non-exclusive, revocable licence
to view the Site for personal, non-commercial use only. No other use is
permitted without our prior written consent.
9. Third-Party Links and Services
The Site contains links to third-party sites (including PhonePe, WhatsApp,
Google Maps). We do not endorse and are not responsible for the content,
policies, or practices of those third parties.
10. Disclaimers and Limitation of Liability
- The Site is provided on an "as is" and "as available" basis, without any
warranty of any kind, express or implied.
- We do not warrant that the Site will be uninterrupted, error-free, or
secure, or that defects will be corrected.
- To the maximum extent permitted by law, in no event shall the Company,
its directors, employees, consultants, or agents be liable for any
indirect, incidental, special, consequential, or punitive damages
(including loss of profit, data, goodwill, or any intangible loss),
arising out of or in connection with your use of, or inability to use, the
Site or any services booked through it.
- Our aggregate liability for any claim arising out of or relating to these
Terms or any service booked through the Site shall not exceed the amount
actually paid by you to us for that specific service.
- Nothing in these Terms limits our liability for fraud, death, or personal
injury caused by our negligence, or any liability which cannot be excluded
under applicable law.
11. Indemnity
You agree to indemnify and hold the Company, its directors, employees, and
agents harmless from any claim, demand, loss, liability, or expense
(including reasonable legal fees) arising out of (a) your breach of these
Terms, (b) your violation of any law or the rights of a third party, or
(c) any content you submit or transmit through the Site.
12. Privacy
Your use of the Site is also governed by our
Privacy Policy, which
describes what personal data we collect and how we use it.
13. Force Majeure
We are not liable for any failure or delay in performance that is due to
causes beyond our reasonable control, including acts of God, pandemic, war,
terrorism, labour disruption, government action, power failure, telecom
failure, isotope supply delays, or Internet outages.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of
India. Any dispute arising out of or in connection with these Terms shall be
subject to the exclusive jurisdiction of the courts of Chhatrapati
Sambhajinagar (Aurangabad), Maharashtra.
15. Changes to these Terms
We may revise these Terms at any time by posting an updated version on this
page. Continued use of the Site after such changes constitutes acceptance of
the revised Terms. You are advised to review this page periodically.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that
provision will be limited or eliminated to the minimum extent necessary, and
the remaining provisions will continue in full force and effect.
